Ladies and gentlemen, infirmary Directors in Poland!

We would like to support you in the hard situation from which you are in, after Minister of wellness Mr.Izabela Lestina issued 14.05.2024. Regulation amending the Regulation on general terms and conditions of medical care contracts and on 30.08.2024 Guidelines on existing government on access to abortion, on the basis of which any wellness institution implementing an agreement with the National wellness Fund on infirmary treatment in the field of gynecology and obstetrics will be obliged to kill unborn children, on the basis of a single certificate the wellness of the pregnant female has deteriorated. Abortion is not a treatment

Danger to Pregnant Women

The guidelines pose a hazard of hindering access to medical services for pregnant women in institutions that will be deprived of a contract with the NFZ, which violates Article 68 of the Constitution. There can be double standards of availability for a conscience clause in patient care, different for doctors – doctors and infirmary directors. Article 2(3) of the Act on the pursuit of the profession of doctor clearly states that "the pursuit of the profession of doctor is besides considered to be the management of the medical subject’.

The Parliamentary Assembly of the Council of Europe in Resolution 1763 of 7 October 2010 on the right to opposition to conscience as part of legal medical care indicated that "no person, infirmary or institution may be legally coerced, held liable or discriminated against by refusal to carry out, assist or submit to abortion, origin abortion, euthanasia or any another act that could origin the death of a human embryo or embryo for any reason’.

Professional ethics of psychiatrists

We urge you not to accept wrongfully imposed financial punishment and to exercise this right in view of the aggressive attack on the life and wellness of Polish mothers of their children and the conscience of doctors.

Chief Medical Council Against Guideline

The Chief Medical Council has besides criticised the guidelines of the Ministry of wellness on abortion procedures. "The creation of guidelines for doctors is simply a domain of only medical technological associations and technological bodies, while the issue of them by the Minister of wellness can be perceived as an effort to exert force on the medical environment"
