SME spokesperson Agnieszka Majewska submitted comments on the amendment of the Public Roads Act.
The aim of the task presented by the Ministry of Infrastructure is to strengthen the process of digital traffic management and road mobility, increase road safety and implement Directive (EU) 2023/2661 of the European Parliament and of the Council. Implementation of these assumptions entails a number of fresh obligations imposed on public authorities and businesses, in peculiar operators and carriers in public transport.
The imposition of fresh obligations on entrepreneurs requires additional costs of PLN tens of 1000 per entity
In a letter to the Minister of Infrastructure Dariusz Klimczak, the Ombudsman notes that imposing fresh obligations on entrepreneurs – related to the transmission of data in the required format by the IT strategy and their updating, as well as conformity assessment and control obligations – entails additional costs of PLN tens of thousands per entity. At the same time, the task envisages launching an IT solution dedicated to micro-entrepreneurs and tiny municipalities, the cost of which will be borne by the Minister of Infrastructure.
According to Minister Agnieszka Majewski, it is appropriate to extend free access to this solution for tiny and, at least to a limited extent, medium-sized companies. It is besides crucial that the proposed regulations enter into force in parallel with the implementation of the software provided to entrepreneurs.
