Digi24: The president consults with judges on the state of justice

On Monday, president Nicoşor Dan discussed the problems of the legal strategy at the Cotrocen Palace with respective judges who agreed to make their criticisms about justice publicly.

After these talks, the head of state met with a group of 20 judges who asked to meet without media participation. Among the participants were besides judges from the ultimate Court of Cassation and Justice (ICCJ), but the president besides spoke with judges who claim that the justice strategy is on track and has no problems.

President Nicușor Dan said that in January he would launch a referendum consultation among judges to find out if the Higher Justice Council (CSM) was acting in the public interest. If this is the case, discussions will proceed in parliament, but if the consequence is against, that is, the group's interest within the judiciary, the head of state said that "CSM will gotta leave immediately".

The strategy has a widespread fear, fueled by hierarchical pressure, judicial inspection interventions and the hazard of disciplinary sanctions, stated judges who met at the Cotrocen Palace with president Dan on Monday. They describe the justice strategy as profoundly dysfunctional, with a power focused on the summit and a deficiency of transparency.

Political nominations for executive positions are heavy criticized. The judges say the results of the contests are frequently known from above. Promotion, transfer and posting are considered arbitrary without real control mechanisms. The judges have requested that the law on justice be amended. The discussions with the judges show that a change in CSM management would aid to remedy the crisis, but no 1 has any warrant that an interior consultation will lead to this.

On Monday, the advanced Court Council declared that it would not tolerate any form of direct or indirect interference with the activities of the judiciary. Furthermore, the CSM points out that a referendum among judges, proposed by the President, is not provided for in the legislation.
