Released declassified papers on acquisition of Pegasus

The agreement to transfer PLN 25 million to the Central Anti-corruption Office in 2017 was signed by then Deputy Minister of Justice Michał Woś and head of CBA Ernest Bejda - according to declassified papers concerning the acquisition of the Pegasus system, which was published by the Ministry of Justice on Friday.


The publication of the papers was requested by MS chief Adam Bodnar, CBA agreed to declassified them.

As we read in the Ministry's Communication, the head of MS has decided to print declassified papers concerning the acquisition of the Pegasus strategy from the Justice Fund's Funds, as "the public opinion should know as much details as possible about the acquisition of the Pegasus strategy by their predecessors".

According to the documents, It was then CBA chief Ernest Bejda who requested the Minister of Justice Zbigniew Ziobry to donate PLN 25 million to CBA in order to acquisition "special equipment to detect and prevent crime". As we read, the letter in this case went to Ziebra on September 15, 2017. "In conclusion, the then CBA chief reported that the cost of the full task is about PLN 40 million" - we read.

Project"completed and completed"

The agreement between MS and CBA was concluded on 29 September 2017. It was signed by then deputy chief of MS Michał Woś and Ernest Bejda. "The legal basis was paragraph 11 of the Justice Minister's Regulation on the FS. This is the paragraph that allowed Zbigniew Ziobrze assign funds from the fund" - reads the MS message.

The CBA was besides expected to set up a peculiar bank account to which the first money went to on October 9, 2017. 3 days later received the amount which amounted to PLN 13 million 360 thousand,was transferred to the account of Matic Sp. z o. o.

The second tranche - which besides went to this company - was 11 million PLN 640 thousand and on November 17, 2017, it went to a CBA account. In December 2017, the CBA reported on the implementation of the project, which was described as completed and completed on 6 December 2017. On 16 January, the "showing the subject of the contract" was to occur. B. Deputy Chief Michael Woś raised no objections and then accepted the report.

Magpie: Ziobro knew

This information was addressed at the Friday press conference by members of the Parliamentary Committee of enquiry for Pegasus.

"The papers about the confidentiality clause present declassified are papers that were sent to Zbigniew Ziobra (b. head of MS), who received them from (then) CBA chief Ernest Bejda" - stressed Magpie. As she added, he requests "to pay the largest sum in the past of the Justice Fund, which was transferred erstwhile to a CBA account".

In the opinion of the chief of inquiry, "Zbigniew Ziobro knew perfectly well that the funds from the Justice Fund would be utilized to acquisition surveillance equipment for citizens, for surveillance by peculiar services in Poland".

Magpie pointed out that in a letter in which Ernest Bejda asks Ziobra to transfer PLN 25 million "it is very clear that the expected cost of the task involving the transportation of equipment, its installation, configuration, training for service, method assistance, etc., will amount to PLN 40 million". "These are measures that flowed so that the Pegasus strategy could be applied in Poland" - noted the MP.

As she noted, the papers received by the CBA committee present e-mails and exchanges between the company where the Pegasus strategy was purchased and CBA officers. "Therefore, on April 24 there was a call for questioning before the committee to Zbigniew Ziobra. I hope Ziobro will come to the committee and answer the questions asked, that he will not chicken out due to the fact that the material is very serious" - said Magpie.

Who was behind the Pegasus affair?

Vice-Chairman Marcin Bosacki (KO) pointed out that 1 of the main tasks of the Pegasus committee is to answer the question "who was behind the Pegasus affair?". "How can you see today, after these declassified documents, after buying Pegasus with certainty, but the CBA, was the very mountain of the Ministry of Justice with Mr. Ziobro at the head" - he noted.

In the opinion of Vice-President of the Commission of the Left Tomasz Trela, it is clear from the declassified papers that Zbigniew Ziobro was aware of all matters. "It is not true, as Minister Ziobro erstwhile said that he was not curious in the Justice Fund and he did not make the decision. He was the 1 who accepted, agreed and gave the orders." - stressed Trela.

Woss: No evidence

Former Deputy Minister of Justice, PiS MP Michał Woś, referring to the declassification of papers regarding the acquisition of the Pegasus strategy wrote: "MS has declassified papers to show that backing for CBA for equipment to catch criminals was legal. After a year of 'work' of the pseudo-commission of Tusk and Magpie (which already costs PLN 9 million), the only 'success' is obtaining documents... from its own government. No fresh information, no evidence."

As Woś noted, "Minister of Justice Adam Bodnar in the Communication admits that I acted in accordance with the regulations." "Prosecution Bodnar will so discontinue the proceedings of the National Prosecutor's Office?" - added PiS MP.

According to him, "The Pegasus+ affair is simply a political theatre to cover the failures of power". "Tusk put the public under surveillance (involved in Russian disinformation) to save an organized group around him: Minister Sławka N. and company" - wrote Woś.
