Polish law powerfully forbids the spread of human ashes. The current proposal to amend the government on cemeteries and burial of the dead does not foresee any change in this issue.
All Saints Day prompts many of us to visit cemeteries, where we leave flowers and light candles on the graves of our loved ones. Until recently, an alternate burial, specified as cremation, was seldom practiced and required a peculiar want of a individual before death. However, in fresh years this burial has become more popular, and even erstwhile the deceased has expressed his want to spread his ashes in mountains, woods or at sea, the law inactive prohibits specified action.
The current Law on cemeteries and burials of the dead clearly states that the corpse can be buried in earthen graves, brick graves, catacombs or sunk in the sea (provided the ship cannot scope land within 24 hours of death on board). It is besides possible to bury ashes in columbaria, which are collective tombs in which urns are stored in niches.
Burial sites must be designated in cemetery areas managed by the municipalities in accordance with the spatial planning plan. Private cemeteries and alleged "memory joints" for the spread of drugs are prohibited and are no longer used.
Although many of us may want to fulfill the want of the deceased individual to have his ashes in a certain place, Polish law prohibits specified actions and imposes penalties on those who do so. The spread of drugs in the forest, on mountain trails or in another places threatens with fines from PLN 20 to PLN 5000 or imprisonment from 5 to 30 days. It's besides not allowed in the cemetery, where only burials according to regulations are allowed.
When it comes to sea burial, this means a decently prepared body sank, not a powder spill. The regulations do not let drugs to be poured into any water tank.
The current Law on cemeteries and burial of the dead has been in force since 1959 and contains provisions that many consider obsolete. It does not foresee the existence of a “memory connector” or the spread of drugs in any place.
Although there was a draft amendment of the Act in 2022, which is presently in the Government's Law Commission, it does not foresee any changes in this respect. Therefore, even after the planned changes to the beginning of 2024, the organisation of the "memory connector" and the spread of drugs in any place will inactive be illegal. However, it is worth noting that the draft amendment has not yet been passed.
