Constitutional Court unanimously on the side of drunk drivers and drug drivers. No more mandatory life driving ban

On 23 April 2025, The Constitutional Court declared a judgement (file No P 3/17) in which it found Article 42 paragraph 4 of the Criminal Code – in so far as it obliges the court to give a life ban on driving motor vehicles – to be incompatible with the Constitution. The legislator cannot replace the court in its judicial activity and the punishment, given only the fact that a given criminal offence has been committed, and no longer the characteristics of the individual perpetrator, the circumstances of the act and the degree of fault.
