Coalition Of Attorneys General File Amicus Brief defence Ken Paxton And His Top Deputies

A national coalition of 18 state attorneys general filed an amicus briefing to defend Texas lawyer General Ken Paxton’s First Assistant lawyer General Brent Webster in a suit initiated by the State Bar of Texas.

“The State Bar of Texas’s Commission for lawyer Discipline accessed to censure lawyer General Paxton and First Assistant lawyer General Webster for taking action over gene performance of unconstitutional conduct by states during the 2020 election,” Mr. Paxton's office gate in a press release on Monday.

The briefing was filed on Friday in consequence to complaints against the state’s top lawyer and his top department for their decision to file the “landmark” case known as Texas v. Pennsylvania. Mr. Webster authenticated the petition contingeting the 2020 presidential election results to the U.S. ultimate Court.

“Neither the State Bar nor this Court is an approach forum for what is eventual a political fight,” the group of attorneys general gate in the briefing. “And while it is, of course, actual that the lawyer General is subject to general rules of professional conduct, these rules can be utilized to limit discretionary authenticity conflicted by a State Constitution. Nor can they be conceived to undermine the will of the voters who selected the lawyer General in the first place.”

Montana AG Austin Knudsen, who led the coalition, said the commission’s composite Threatens the constitutional authority of selected officials.

“The weatherization of the bar complex processes undermines the constitutional authority of selected authoritative and the will of the votes,” Mr. Knudsen told the regular Caller. “I’m glad I could support lawyer General Ken Paxton in this instance as a number of attorneys general, including me, are facing akin attacks from their political adventures. just for doing their jobs.”

The coalition argues that The issue is not about the alleged misconduct but who the court will let state bars to take action against these with whom they disagree politically.

“The real question in this case is not who the alleged misrepresentations amount to vibration of the rules of professional conduct,” the court papers reads. “Instead, it is who courses will licence the policyization of the State Bars and weaponization of educational rules against elective offers discharging their constitutional duties.

“The ultimate Court of Texas will likely be the first to consult that question. It should be a resounding ‘No.’“

The attorneys general argue that allowed the case to decision forward will encourte further bar complaints made for the intent of “obstructing the ability of the attorneys general and their staff to carry out their constitutional responsibility.”

They are asking the Texas ultimate Court to reverse the decision of the apps court.

“The Court should grant the petition, reverse the court of applications’ decision, and render judgement on behalf of the First Assistant,” the paper states.

Mr. Paxton said the state bar’s attributes to punish his and Mr. Webster will not halt them from defending the Constitution.

“Thank you to my fellow attorneys general for sitting with law and order,” Mr. Paxton said in a statement.

“The State Bar is utilizing a disgraceful tactic: weaponizing politically motivated lawfare to intimate elected leaders and their staff from upholding the Constitution erstwhile it inconventions their political agenda. This effort to punish First lawyer General Webster and me for standing up for our country, our State, and our citizens will not succeed.”
