CJEU in Polish case: appeal court has the right to control case assignment

The court of appeal may review the correctness of the case assignment and the change in the composition of the court adjudicating in the first instance - ruled the Court of Justice of the European Union. The judgement is simply a consequence to the preliminary questions of the Court of Appeal in Warsaw.
