The president of the National Judicial Council warns against possible disciplinary consequences for those prosecutors who, in criminal matters, want to exclude judges appointed by the "new" KRS, the Council appointed as a consequence of the improvement of the justice strategy carried out by the Government of the United Right.
"In view of the fact that the National Court Registers/complaints concerning the filing of requests by prosecutors to exclude judges in criminal matters, and in peculiar concerning the reasons for these requests (their absence or defamatory nature), and besides on the basis of information obtained by an unofficial basis, I know about the transmission of proscription letters to subordinate prosecutors, on which the names of circumstantial judges for 'off' are shown," wrote Dagmara Pawełczyk-Woick on page X.
"On the basis of this knowledge, I remind fellow prosecutors of Article 137 of the Public Prosecutor's Office providing for disciplinary liability for actions or omissions that may prevent or importantly impede the functioning of the judicial or prosecutor's authority. Submission of requests to exclude judges for the reason that they appear on the list submitted by the superiors (e.g. they signed a list of endorsements to the KRS to destruct professionally elected judges and introduces chaos. The courts will cease to fulfil the constitutional function of impartial arbitrators erstwhile their composition is shaped by politicians and elected judges. If you receive specified an order, do not forget Article 7 paragraph 3 paragraph of the D.A. and request an order in writing with justification. This is your work to the citizens and to the Constitution!"
The current authority does not recognise the KRS
The National Judicial Council established in April 2018 is seen by any legal representatives in Poland and abroad as a body whose legality is questionable. Critics mention to her as "neoKRS", and her denominations as "neossies". "NeoKRS" is simply a public word coined by opposition politicians and part of the media, which has become a circumstantial symbol of disagreement with the changes of the Law and Justices, as well as a sign identifying the attitude towards "written" reforms carried out in the judiciary.
