Former Head of the territory Attorney's Office in Wrocław, Justyna Pilarczyk, may hear allegations that endanger her punishment for up to 10 years in prison. According to Onet portal, the case concerns the termination of proceedings against Justyna Helcyk, leader of the Lower Silesian brigade ONR, and a possible breach of powers in order to accomplish individual benefits.
Balls of the remission of the investigation against the leader ONR
The case dates back to the time erstwhile Justyna Pilarczyk, as a prosecutor, brought an indictment against Justyna Helcyk to court, accusing her of spreading hatred speech. However, the decision to file the indictment was withdrawn by Pilarczyk, which, as Onet points out, was to take place under force from her superiors from the Regional Prosecutor's Office. This step has become an inflammatory point in the full case.
- "The decision to discontinue the investigation was a surprise to many, especially since Pilarczyk herself initially sought to bring Helcyk to justice."
The Onet portal emphasizes that following the withdrawal of the indictment, Justyna Pilarczyk's career gained momentum. She promoted to the position of press spokesperson for the territory Attorney's Office and then assumed the position of head of that institution.
Investigation of the National Prosecutor's Office and possible allegations
Currently, the case of Justyna Pilarczyk is dealt with by the National Prosecutor's Office. According to the institution's spokesman, Proct. Przemysław Nowak, the investigation concerns the suspicion of committing a crime under Article 231 of the Penal Code, which provides for a conviction of up to 10 years in prison for exceeding rights in order to accomplish a property or individual benefit.
- "The department received a request to analyse the prosecution's investigation into the crime of Art. 231 of the Criminal Code," he confirmed in an interview with Onet Prok portal. Przemysław Nowak.
Voices of criticism and allegations of cyclicalism
The allegations against Pilarczyk concern not only her actions in the case of Justyna Helcyk. The National Prosecutor's Office's study points to the anticipation of "hand-held control" of the judiciary in 2015-2023, which raises questions about the function of another people in this matter. The president of the investigation team, prosecutor Katarzyna Kwiatkowska, did not hide her criticism of the erstwhile head of the territory Attorney's Office in Wrocław.
- “I have no uncertainty that the prosecutor has treated the D.A.'s vows as a set of empty phrases that she was willing to abandon for her own benefit.”
Kwiatkowska points out that Pilarczyk was to receive many financial awards, which could further motivate her actions. In conversation with Onet he describes Pilarczyk's attitude as a manifestation of conformism and cyclicalism.
- "For her own purposes, she sacrificed the good of justice and should so endure consequences. possibly at the phase of the investigation it will turn out that another persons active in the case should be covered by charges, e.g. Deputy Regional lawyer Mr. Duplaga, who, after all, issued Proc. Pilarczyk orders.”
What's next on the case?
The case of Justyna Pilarczyk is pending in the shadow of serious accusations of manipulation in the judiciary. If the charges are confirmed, the possible consequences may include not only imprisonment but besides failure of public rights and exclusion from the profession of prosecutor. Will the investigation uncover a wider mechanics of force in prosecutorial structures? The answer will be crucial for the future of this matter.
So far, Justyna Pilarczyk has not publically referred to her charges. The National Prosecutor's Office has announced further steps in the investigation and the public remains to analyse whether justice will find its place in this complex case.
