The case was reported by the National Prosecutor's Office, Przemysław Nowak. 8 members of the Court of State were notified on 12 June that year.
Since January, the judges of the Court of State who have been appointed after the last parliamentary elections have unsuccessfully sought to convene a sitting of the full composition of the Court. They encounter opposition from Margaret Manowska, the president of the Court, who, according to the Rules of Procedure, has control over his activities. This situation makes it hard to consider cases involving the highest public officials liable for violating the Constitution and another laws.
On 20 March this year, six Judges of the Court requested Manowska to convene the full membership and to amend the Rules of Procedure of the TS, calling for, inter alia, a draw of the rulings and transparency of the meetings. The letter was signed by six judges: Przemysław Rosati, Kamila Ferenc, Jacek Dubois, Marek Małecki, Marek Mikołajczyk and Piotr Zientarski.
In response, dated 19 April this year, Manowska stated that the amendment of the TS Rules of Procedure was the sole competence of the president and could not be carried out at the request of another entities, preventing the submission of the application.
The fresh judges of the Court of State are proposing amendments aimed at limiting the powers of the president of the TS, specified as the introduction of rules on drawing the rulings and expanding the transparency of meetings. However, any amendments to the Rules of Procedure must be approved by the full composition of the Court, whose convening of Margaret Manowska is avoided.
