Bogdan Święczkowski and 100 pages of the report. That's how the TK president was expected to study Poland

The president of the Constitutional Court, Bogdan Święczkowski, was to send a study to key American officials. According to a paper received by the media, they were criticised by the Polish government and the European Union for "measured at the TK". Details have been released.


In the media, there is talk about how the president of the Constitutional Tribunal was to study Poland to the US. A week after the presidential election, which was won by Karol Nawrocki, a peculiar letter was to be given, the title of which itself was eloquent: "The process of 'returning the regulation of law in Poland' from the position of the regulation of law. Unlawful actions against the Constitutional Court from 13 December 2023". It was signed by Bogdan Świętczkowski and was to be prepared by the "experts team" of the TK.

The paper was addressed, among others, to U.S. ultimate Court president John G. Roberts and U.S. lawyer General Pam Bondi. Its content reached Onet. "Polish Constitutional Court is presently struggling with unprecedented attacks from politicians of the parliamentary majority and government", quoted the letter.

As stated, Świętczkowski is of the opinion that "these actions are aimed at undermining the independency of the judiciary in Poland". The study mentions, among others, "no publication of TK rulings", "zeroing of judges' salaries" or "no placement of vacant seats in the Court".

"Confronting the independency of the judiciary and unprecedented attacks on institutions appointed to defend citizens' rights and freedoms must not stay unnoticed," stated the letter. It is besides indicated that "international actions" are expected to weaken the TK.

Letter of the president of the Constitutional Tribunal full of bias

The paper has almost 100 pages and its aim was to "try to draw global attention to the situation of the Constitutional Court in Poland". "The TK is 1 of the last bastions of Poland's sovereignty, which makes it the mark of attacks from both the government and global organisations" – as stated in the report.

Journalists of Onetu, who first discussed this document, pointed out that it affected bias and the complete omission of certain facts. "It is evident that this is an effort to make the impression that the TK crisis began in 2023 and not under the regulation of the Law and Justice," we read.
