Marian Banas, who was appointed by the erstwhile Law and Justice Government to be the NIK chief, rapidly found himself in conflict with this party. The president of the Chamber of Control began to be burdened with allegations and suspicions concerning various taxation schemes.

Even though a call has already been made to dismiss the President, it was besides late for that due to the fact that he assumed immunity. Banaś was allegedly to engage in the last election campaign, promising to usage his influence in the institution to support the then power, including control over the disclosure of abuses at the National Centre for investigation and Development.

Government television, publishing tapes on the eve of the election, attempted to usage the recording of Banas' conversation with Chmaj aimed at weakening the Confederacy in which the boy of the NIK president competed. In a video aired by TVP Info Banaś, he mentioned, among others, the "carrying" of his boy on the Confederate list in order to hinder a possible coalition between this organization and PiS.

Although this publication could have received the Confederacy's votes, it most likely contributed to strengthening the future coalition "13 December". However, the actions of the then “great strategists” of TVP could have contributed to the failure of the organization they were expected to help.

President Banaś played a affirmative function for the current coalition, so it may now be paying him back ‘long’. The lawyer General has revoked the request to waive immunity to the NIK President, and investigators must supplement the evidence.

Investigations concerning, among others, suspected irregularities in his property statements and taxation returns have been conducted in Białystok since 2019. Minister Adam Bodnar, as lawyer General, decided to transfer the material to the prosecutor's office in Białystok.

The first motion to waive immunity went to Parliament at the end of July 2021, but was not considered. According to investigators, Marian Banaś lowered his income from the lease of the building in Krakow from 2015 to 2020, exposing the Treasury to the failure of over PLN 50 1000 due income tax.

Currently, the Regional Prosecutor's Office in Białystok has again requested the waiver of immunity for Marian Banasia and has extended it by 2 further allegations of taxation irregularities and possible excess of powers. However, there will be no vote on the waiver of immunity.
