The Belgians joined the proceedings before the global Court of Justice on Israel's accusations of genocide in the Gaza Strip. The investigation initiated South Africa.
On Tuesday, the Belgian Government filed a alleged declaration of intervention in the MTS in The Hague. He did so on the basis of Article 63 of the Statute of the MTS, which allows the States Parties to the Convention to present their explanation of its provisions if they are the subject of dispute before the Court. Belgium is organization to the 1948 UN Convention on the Prevention and punishment of the Crimes of Genocide.
According to the MTS Communication, Belgium focuses on the explanation of Articles I to VI of the Convention, and in peculiar on the definition of genocide and on the intention to commit this crime, crucial to its legal competence.
Intervention does not mean that Belgium becomes a organization to the dispute between South Africa and Israel. Its intent is to present its own legal position on the explanation of the provisions of the Convention; if it is included in the ruling, it will besides be binding on Belgium.
In a request made in 2023, South Africa accused Israel of committing genocide in the Palestinians in the Gaza Strip during an armed operation against Hamas terrorist organization. Israel argued that his actions were an act of self-defense, and akin accusations were a gross distortion of history.
In January 2024, the MTS ordered Israel to take temporary measures to prevent possible acts of genocide and to supply humanitarian aid for Gaza. However, the final judgement in the case can inactive be awaited for a fewer years.
Spain, Ireland, Brazil, Colombia, Mexico and Turkey had previously joined the case.
