Lewandowski with the proposal
Counselor Bartosz Lewandowski announced on the X portal that a letter was sent to the legislature marshals requesting the termination of Senator Adam Bodnar's mandate.
The basis of the motion is the unprecedented fact that the Senator issued a procedural decision in the course of his investigation on 26 July (not taking into account the request to exclude Proc. Dariusz Korneluk due to his deficiency of impartiality), reserved exclusively for active prosecutors active in the conduct of preparatory proceedings Lewandowski wrote.
Marcin Romanowski's lawyer points out that politicians from the majority of the ruling did not have the power to reject the motion to exclude Konreluk and that while acting as prosecutor, he violates the laws which prohibit the appointment of the senator.
Lewandowski besides stresses that Bodnar did not mention the application to the competent prosecutor, e.g. Deputy lawyer General. It besides adds that the situation is complicated in the context of the merger of the functions of lawyer General and Minister of Justice, which was restored by the Law and Justice Government.
As Lewandowski continues:
In the course of the investigation, [Adam Bodnar – ed.] besides represents the organization to the proceedings, i.e. the allegedly injured Treasury represented by the Minister of Justice. So this means that the senator has issued a trial decision in an investigation in which is organization to the proceedings, and at the same time, as a minister, he forwarded opinions to the Independent Prosecutor's Office for the immediate imprisonment of his political opponent.
The lawyer adds that in the event of the Senate's Senate's legislature mandate being declared void, the Minister will be entitled to an appeal to the home of Extraordinary Control and Public Affairs of the ultimate Court, appointed by the Law and Justice Government.
Romanowski accuses of “recidy”
Marcin Romanowski besides commented on the situation as a whole, accusing Senator Bodnar of "recidy", a expected violation of the law regarding the liquidation of public media companies. Romanowski claims that he had previously applied to the Marshals of the legislature of Kidawa-Błońska to extinguish Bodnar's mandate, but did not receive an answer. Now Bodnar, in his opinion, was expected to violate the constitution by carrying out criminal proceedings, without relying on legal opinions.
Romanowski wonders whether this time the Marshal of the legislature will fulfil his duties, or whether he will exposure the legislature to acting in an unauthorised composition and himself to criminal work in accordance with Art. 231 couples. 2 Penal Code, which provides for a punishment of up to 10 years in prison.
