If banks are truly afraid of anyone in the full universe of disputes arising over debt agreements, it is surely the Luxembourg Court. This is illustrated by the last strategy of their conduct – i.e. taking all possible actions calculated to discontinue the proceedings initiated on the basis of preliminary questions addressed to the CJEU, so that no judicial precedents are created, creating grounds for pursuing further claims against them.
