Macierewicz claims that as Prime Minister Tusk oversaw officials liable for the refurbishment of the presidential aircraft at Russian plants, which allegedly led to the crash. However, it does not explain how these accidents are linked to the crash, since the aircraft was operational during the flight.
The allegation of diplomatic betrayal concerns Tusk's decision to apply the Chicago Convention to analyse the disaster, which, according to Macerewicz, prevented Poland's full participation in the investigation. In addition, PiS policy accuses Tusk of failing to recover the wreckage of the aircraft and another materials. Macierewicz accuses Tusk of acting against Poland in relations with Russia.

Antoni Macierewicz made many notifications concerning the Smolensk disaster, accusing many people, including Donald Tusk, Radosław Sikorski, Bogdan Klich, Jerzy Miller and Maciej Lask of various crimes. Tusk was to know about the planned visit of the Polish delegation to Katyń in December 2009, and allegedly pursued a plan to destruct president Lech Kaczyński from participating in these ceremonies. Macierewicz accused anyone who did not share his explanation of the assassination, including prosecutors investigating, of sabotaging the investigation.
If specified as Macierewicz were at the top of power, distinguished, financed and protected, then the Law and Justice organization is simply a organization of betrayal of Poland.
