One associate of the Civic Coalition expressed concerns that there might be a repetition of the situation in which the Prime Minister would ignore the work to print resolutions. Members are considering different options, but are not certain that it is possible to vote on resolutions at this point.

The full situation has its roots in October 2015 during the last session of the 7th Parliament. At that time, Members of the PO-PSL, who were then a majority, elected 5 judges of the Constitutional Court by means of parliamentary resolutions. This choice was possible thanks to the fresh Constitutional Court Act of June 2015. This part of government allowed the 7th Sejm to elect fresh judges, even though their word of office was to begin after the 2015 parliamentary elections.

After the elections in which the majority won the Law and Justice, the fresh Sejm immediately proceeded to make changes in the Constitutional Court. Parliament amended the Constitutional Tribunal Act, allowing, among others, the re-election of judges. During the night of 25 to 26 November 2015, the PiS organization annulled resolutions that led to the election of judges during the erstwhile term.

2 December 2015, The Sejm elected Henryk Cioch, Lech Morawski, Mariusz Muszyński, Piotr Pszczółkowski and Julia Przyłębska as judges of the Constitutional Court. However, the Constitutional Court, chaired by Andrzej Rzeplinski, ruled that the provision that allowed the selection of 3 judges during the 7th word was in accordance with the Constitution. For this reason, those chosen later should not sit in the Court.

The judges elected to the place of judges elected by the erstwhile Sejm are Cioch, Morawski and Muszyński. The first 2 died in 2017, while their seats were taken by Jarosław Wyrembak and Justin Piskorski. It is Muszyński, Wyrembak and Piskorski who are now referred to as “dublers”.
