A ruthless prison for breaking the Constitution!

For respective weeks now, different environments associated with alleged political elites have been talking about the request to amend the Constitution of the Republic of Poland. This request was caused by the pandemic, now by the “special military operation” (read – war) conducted by Russia in Ukraine.

Probably the real reasons for starting another media propaganda action are somewhat different and related primarily to the fact that after Russia's aggression it is possible to share (PiS – PO) pushing through fresh laws to enslave society more.

Personally, I am not convinced that the present Constitution is so scandalously wrong. Certain provisions should most likely be further detailed, specified as the 1 that ambiguities the president of the Republic and the Minister of National Defence in terms of the supervision of armed forces or the appointment of the Chief Commander of the Armed Forces during the war.

Much more dangerous for Poland is evident violation of the Constitution by the Republic of Poland. Examples can be multiplied. From introducing preventive censorship, through abuse of the State apparatus for political purposes to the introduction of fresh taxes under the name of fees.

But speaking of changes to the Constitution, it would be good for the basic law of the Republic of Poland to include new, below mentioned provisions:

1. Violation of the Constitution Punishment of Absolute Prison for the period from 3 years to the highest penalty. The punishment for violating the Constitution shall be determined by the court.
2. Every citizen has the right to bring an action to the courtIn which it will indicate who and to what degree the Constitution has broken. The court yet decides whether the action is justified. If so, the court, on behalf of the Nation, accuses the guilty individual of violating the Constitution.
3. Any citizen who has not been deprived of public rights by a court, He has the right to submit his candidacy in the election. The application for a candidacy may require a deposit, the amount of which may not be higher than: 2000,- PLN in municipal elections, 5000,- PLN in region elections, 10,000,- PLN in provincial elections and 15,000,- PLN in nationwide elections. The bail is returned if the candidate received at least 10 votes in the municipal election, 25 votes in the region election, 50 votes in the provincial election and 200 votes in the nationwide election.
4. No citizen of the Republic of Poland located in the country or in an establishment (object) having the position of the Republic of Poland (diplomatic place, ship, plane and t.p.) may not be issued, under any circumstances, to another country. A citizen of the Republic located in the country or in an establishment (object) having the position of the Republic (Diplomatic place, ship, plane, etc.) may be tried only by the Court of the Republic and only if the alleged act is simply a crime defined in Polish law.
5. It is unacceptable to combine any functions within the authorities: legislative, executive, judicial.

These provisions will let readers to realize that changes in the Constitution are desirable and even necessary. However, the ruling authorities will guarantee that no of the proposed provisions in the Constitution he did not find a place. On the another hand, it is good to remember that the Constitution is not a bill that should be amended twice during each parliamentary term, specified as the Goods and Services taxation Act.
