Since mid-2024, there has been a fight by pensioners who were wronged during the last 10 years erstwhile recalculating pensions. The Constitutional Tribunal ruled that this was unconstitutional in its judgement of 4 June 2024. The number of victims is estimated at around 150,000 to even more than 200,000 people. Their possible benefits include an increase in current pensions by PLN 1,200 (on average) and compensation of PLN 64,000 (on average). These amounts were correct in the event of the execution of the Constitutional Tribunal's judgement by ZUS. Due to the deficiency of publication of the judgement in the diary of Laws, the courts replace ZUS. However, the courts have many restrictions on awarding money to pensioners. For example, 1 of the provisions allows judges to order compensation only 3 years back, although there are courts that admit compensation from the very minute erstwhile the pensioner was wronged. Interest depends on the fact that ZUS was at responsibility erstwhile recalculating pensions. The majority of courts find that ZUS was not at responsibility due to the fact that it applied provisions that only later turned out to be inconsistent with the Constitution of the Republic of Poland.
