"An unsuccessful attempt". Michael Woś ignored the D.A.'s call for action to hear the charges

On Monday, the PiS Member, Michał Wosi, was to be declared, but the curious organization himself claims that he was not informed. A spokesperson for the National Public Prosecutor's Office, Przemysław Nowak, in an interview with Virtual Poland, stressed that despite an unsuccessful effort to deliver the call to the address of Wosi's residence, his defender was notified of the deadline.

Przemysław Nowak explained that the act of announcing the charge and proceeding of Michał Woś was planned for 5 August 2024. The effort to service the fishy at the address indicated was unsuccessful. However, Wosia's defender was effectively notified of the deadline.

The policy defender requested a change of the proceeding deadline for the period after 14 August 2024, due to scheduled leave. The prosecutor replied that in the event of leave, the defender is obliged to appoint an alternate to participate in the activities. In response, defender Wosia reported that Michał Woś does not consent to the deputy's representation and sent a modified power of lawyer to defend, excluding the establishment of a replacement defender to participate in the hearing.

Michał Woś commented on the prosecution’s actions on his social media, saying: “Farsa continues. Journalists are calling due to the fact that they have a tip that for present I had any call from the neo-prosecution office that I was not informed of.” He besides added that his lawyer offered to arrange the deadline by telephone, but the prosecution refused. Background: Justice Fund and acquisition of Pegasus

The Sejm waived immunity for Michał Wosi on June 28, 2024. The National Prosecutor's Office requested approval to bring Wosi to criminal liability in connection with an investigation concerning the acquisition of Pegasus software by the Central Anti-corruption Office (CBA) from the Justice Fund.

From 2017 to 2018 Michał Woś served as Deputy Head of the Ministry of Justice in the Government of the United Right. He was authorised by then Minister of Justice Zbigniew Ziobra to have funds from the Justice Fund. In September 2017, he asked the Ministry of Finance to amend the fund's financial plan, which allowed to transfer PLN 25 million to the CBA for the acquisition of the Pegasus system.

The Public Prosecutor's Office claims that the powers and responsibilities of Wosi have been exceeded due to the fact that the CBA Act states that this peculiar service is financed by the State budget. In addition, decisions concerning the acquisition of Pegasus were made even before the entry into force of the Regulation in 2017, which allowed transfers of funds from the Justice Fund outside the competition.

Accusations against Michał Wosi

In May 2024, lawyer General Adam Bodnar made a motion to waive the immunity of Wosi. The allegations made by the erstwhile Deputy Minister of Justice include an abuse of functions by a public officer (Article 231 of the Criminal Code), an abuse of trust (Article 296 kk) and large-scale property damage.

The Michael Woss case is complicated and controversial. On the 1 hand, we have allegations of serious infringements, on the another hand – claims of policy about procedural irregularities and media show. erstwhile this case is over, time will show, but it will surely be 1 of the louder political processes in Poland in fresh years.
