13 years ago, Jolanta Brzeska, a tenant, was burned alive in the Kaback forest. No 1 responded to her execution until today.
Jolanta Brzeska - a local activist opposed to the alleged chaotic privatization and co-creator of the Warsaw Locator Association - was burned alive in the Kaback Forest in Warsaw on March 1, 2011. The case has not been cleared up until today.
Brzeska's activity to defend the rights of tenants began with opposition to the actions of Mark M. – a typical of the heirs of the erstwhile tenement owners at 9 Nabielak Street, which was returned to them by the city in 2006.
Brzeska's father had previously been assigned to an flat after he had rebuilt a levelled building after planet War II. It was decided to get free of the "meat insert" building (households) and rent their apartments for much higher rents. To this end, people were made hard to live in various ways - from respective increases in rent (at any point Brzeska was to pay PLN 3,000 rent for 77 square meters), by invading homes and cutting off electricity, gas or water, to carrying out endless burdensome renovations.
In this situation, Brzeska, together with another tenants in a akin situation, established the Warsaw Locator Association, which dealt with the fight against home cleaners and claims traders. Brzeska participated in protests against the implementation of eviction sentences and supported the evicted. She herself gained legal knowledge, which she later successfully used. Her association kept a registry of eviction cases and demanded that the city council adopt and implement demands related to the protection of tenants.
Brzeska was the last tenant of a tenement home who was not intimidated. A modest pension was not adequate to pay the rent, so in the end for debts of PLN 20 1000 she received an eviction order, and the bailiff seized part of her pension.
On March 1, 2011, the body of Jolanta Brzeska was found in the Kabacca Forest. origin of death was arson resulting in carbon monoxide poisoning, thermal shock, and extended burns. The female burned alive.
The investigation into Brzeński's death was reckless - individual items taken from the deceased's home were lost, and the body was not identified for a long time. The first 2 years of the D.A.'s office were leaning towards a version of... suicide, why many facts were contradicted from the beginning. Eventually, it was considered that there was a murder, but the Warsaw territory Attorney's Office dropped the case in 2013 due to not detecting the perpetrators.

On August 19, 2016, Minister of Justice and lawyer General Zbigniew Ziobro announced a reopening of the investigation into the execution of Jolanta Brzeska and entrusting him to the prosecution outside Warsaw. At the same time, proceedings were initiated against prosecutors conducting an earlier investigation “for gross deficiencies and omissions in the first phase of the investigation involving the explanation of the circumstances of Jolanta Brzeska's tragic death”.
In August 2018, the Wrocław court issued a ruling on the provisional detention of Mark M. for 3 months. However, the allegations he heard did not concern the case of Jolanta Brzeska and the building at 9 Nabielak Street and another properties.
The lawyer General accused the first investigation of adopting a misqualified act, deficiency of an investigation plan, engagement of inexperienced prosecutors and officers, inaccurate examination at the site where the body was found, and failure to supply much evidence or analyse them long after the incident. In August 2021, the D.A.'s office again failed to analyse the unsub. At the same time, she did not see mistakes in erstwhile police and prosecution activities.
On February 25, 2021, the Sejm adopted a resolution commemorating Jolanta Brzeska on the 10th anniversary of her assassination, and on June 10, 2021 received the honorary citizenship of Warsaw.
In 2021, a movie “Loktor” directed by Michał Otłowski was created, which tells about the reprivatisation and assassination of Brzeska. The function of Janina Markowska, inspired by Brzeska, was played by Sławomir Łozińska.
The substance of reprivatization of property has been burning the emotions of Poles since the 1990s. It was not until August 2021 that the Sejm adopted an amendment to the Code of Administrative Procedure, which means that 30 years after the administrative decision to lose the property or change its owner, it would not be possible to initiate proceedings to challenge specified a decision, e.g. on the property received years ago.
The subject of chaotic reprivatization was present in most large urban agglomerations, throughout the country. The loudest cases come from Warsaw. Another aspect of the case, in addition to the tragedy of thousands of people thrown on the street, are claims of judaic communities against the property of the undecided - property of citizens of the Second Republic who died as a consequence of extermination and war. Under the law, their property was seized by the state's treasury. The case was the origin of many global tensions between Poland and the US and Israel.
